ANCHORAGE, Alaska — Sarah Palin unlawfully abused her power as governor by trying to have her former brother-in-law fired as a state trooper, the chief investigator of an Alaska legislative panel concluded Friday. The politically charged inquiry imperiled her reputation as a reformer on John McCain's Republican ticket.
Investigator Stephen Branchflower, in a report to a bipartisan panel that looked into the matter, found Palin in violation of a state ethics law that prohibits public officials from using their office for personal gain.
The inquiry looked into her dismissal of Public Safety Commissioner Walter Monegan, who said he lost his job because he resisted pressure to fire a state trooper involved in a bitter divorce and custody battle with the governor's sister. Palin says Monegan was fired as part of a legitimate budget dispute.
Monegan's firing was lawful, the report found, but Palin let the family grudge influence her decision-making — even if it was not the sole reason Monegan was dismissed.
"I feel vindicated," Monegan said. "It sounds like they've validated my belief and opinions. And that tells me I'm not totally out in left field."
Branchflower said Palin violated a statute of the Alaska Executive Branch Ethics Act. Lawmakers don't have the authority to sanction her for such a violation, and they gave no indication they would take any action against her.
Under Alaska law, it is up to the state's Personnel Board — which is conducting its own investigation into the matter — to decide whether Palin violated state law and, if so, must refer it to the Senate president for disciplinary action. Violations also carry a possible fine of up to $5,000.
Palin attorney Thomas Van Flein disagreed with Branchflower's conclusions. "In order to violate the ethics law, there has to be some personal gain, usually financial. Mr. Branchflower has failed to identify any financial gain," he said.
Palin and McCain's supporters had hoped the inquiry's finding would be delayed until after the presidential election to spare her any embarrassment and to put aside an enduring distraction as she campaigns as McCain's running mate in an uphill contest against Democrat Barack Obama.
After a court fight to block the report failed, the panel of lawmakers voted to release it — though not without dissension. The panel did not vote on whether to endorse its findings.
"I think there are some problems in this report," said Republican state Sen. Gary Stevens, a member of the panel. "I would encourage people to be very cautious, to look at this with a jaundiced eye."
The state paid Branchflower, a retired state prosecutor, $100,000 to prepare the nearly 300-page report. He interviewed or accepted affidavits from about two dozen people in the eight-week investigation.
"Legislative Council seriously overreached, making a tortured argument to find fault without basis in law or fact," McCain campaign spokesman Meg Stapleton said.
The Legislature could vote next year to censure Palin, but committee members appeared divided over the report and Democratic state Sen. Kim Elton, the committee's chairman, gave no indication that would happen.
Stapleton also dismissed the report as "a partisan-led inquiry run by Obama supporters." The inquiry has been dogged by such criticism since Democrat Hollis French, who oversaw the investigation, predicted an "October surprise" for the McCain campaign.
Elton rejected the accusation of partisanship.
"When we began investigating this, we had no idea that Sarah Palin would be a part of the national ticket," said Elton, an Obama supporter.
The report notes a few instances in which Palin pressed the case against trooper Mike Wooten, but it was her husband, Todd, who led the charge. Todd Palin had extraordinary access to the governor's office and her closest advisers and he used that access to try to get Wooten fired.
Gov. Palin knowingly "permitted Todd to use the governor's office and the resources of the governor's office, including access to state employees, to continue to contact subordinate state employees in an effort to find some way to get Trooper Wooten fired," Branchflower's report reads.
Wooten had been in hot water before Palin became governor over allegations that he illegally shot a moose, drank beer in a patrol car and used a Taser on his stepson. The Palins said they feared for their family's safety after Wooten made threats against them.
In proceedings revealed by the report, former Alaska State Trooper Col. Julia Grimes told investigators that Sarah Palin called her in late 2005 to discuss why Wooten hadn't been fired, and Grimes told her the inquiry was confidential by law.
"Her questions were how can a trooper who behaves this way still be working," Grimes said. "I asked her to please trust me, that because I can't tell her details I would ask her to please trust me that I would take the appropriate action if and when I knew what the findings were. … I couldn't have another conversation with her about it because, again, it's protected by law."
Grimes said Todd Palin also contacted her by telephone in late 2005 to discuss the confidential investigation of Wooten.
Wooten's disciplinary case was settled in September 2006 — months before Palin was elected governor — and he was allowed to continue working as a trooper.
After Palin's election, her new public safety commissioner, Monegan, said he was summoned to the governor's office to meet Todd Palin, who said Wooten's punishment had been merely a "slap on the wrist." Monegan said he understood the Palins wanted Wooten fired. "I had this kind of ominous feeling that I may not be long for this job if I didn't somehow respond accordingly," Monegan told the investigator.

Whether you support her or not, you had to see this coming. It would be more prudent for any control freak have the only people able to review your actions answer to you. If things look badly for your cause, replace the people not providing the answer you want. Make them dependant on your OK for their livelihood, and you control all situations.

Monegan owes the Palin's a civil suit.
The Palins owe us all an apology for being despicable abusers of power who lie about it while smiling and claiming to be "mavericks".
McCain owes his supporters a respectable VP.
Yep... throw all those things in and we can call it even.
Or, we could all just conclude that if McCain became president and croaked, that these idiots would be our "First Family". If that doesn't scare you... you need your head examined.

So lets investigate the investigator a little. He is a Democrat. He also said at the start of his little investigation that there would be a surprise in Oct. Does that tell you he had his marching orders already. His findings is little more than an opinion paper as no one was put under oath. Evidence is lacking except from a disgruntled employee that could not take direction from a woman. This sounds a little like the Obama opponent that dropped out because he was sued to open up his divorce papers. It sounds an awful lot like Obama's first opponent that was forced out due to another lawsuit on filing procedure.
If you can't win on your own. Drag dirt and sue. Boy that is real change or is it just Chicago politics.
Oh by the way the maximum if the Senate decides to go forward with more investigation is a $5000 fine.

Are you saying that the severity of the fine decides as to whether its legal or not? That is to say, ethics are not laws so you need not be ethical? Maybe this is why all of the "libs", as you call them, need to dictate every ones life through legislation.

- Yes, jack... we are painfully aware of that. Nobody is trying to get those who are already "locked-in" to change their vote. Such an endeavor would not bear fruit.
It's the undecided and independent voters, not the Republican base, that we're after.

Todd Palin says he got help from contractor "buddies." Palin decides no need for building permits anymore so no paper trail. Seems corruption is rampant in Alaska.

Ask the "Obamaites" and they will tell you that this is a non-story or not an issue. I am certain if it involved the Republican candidates it would be a story and an issue. In fact you would have the same old group of left-wing posters raging here on good ol'Redding.com and the witch hunt would be on, if it involved McCain/Palin.
Certainly enough of an issue to be covered extensively by the liberal media news station and enough for a Congressional inquiry to be initiated. But don't worry, the "do nothing" Democraticaly controlled Congress that is currently setting will find there is nothing wrong. After all why should they break their track record of being the worst sitting Congress since the inception of this country. Besides, what would your week be without a little bit of "Pelosi speak"? This too will be the "Bush Administrations" fault, just like the menopausal phase of her life or her sagging facelift.
You must realize that the Democratic Party will say anything and do anything to get their candidate elected. After all this was foretold and promised by "YEEHAW" Howie Dean, Head of the Democratic Party, when they lost in the last election or as their claim that the election was stolen. Obama's promises are the same promises I have heard for years. The Clinton's had eight years to fix health care, social security, and the budget. Yep, they balanced the budget and had a surplus due to the "borrowing" from the Social Security Fund. Ol' Bill( I can't keep my trout in my trousers" Clinton had several chances to kill Bin Laden before he had his ilk kill thousands in New York. Instead he lobs a few cruise missles at a deserted training camp and then claims he did something to protect us. Great Homeland Secrurity.
No real plan.

- Whadda ya talkin' about? That's all we've heard from McCain for the last week! We heard it all before, earlier in the race as well. It doesn't amount to a hill of beans... So the electorate is universally ignoring it... even though the press has given it more than a fair amount of time.

- Absolutely untrue. The Obama campaign has said that all registrations should be examined. I maintain the same. ACORN made the mistake of employing a bunch of minimum wage people to collect registrations... some of them filed some that were obviously wrong... with names like "Will E. Coyote". I don't think you have to worry about registrants like that actually getting the chance to vote. Any county registrar who does not vet the incoming registrations is derelict in their duties.

Any respect I had for John McCain went away with his pick of Palin. I watched a rally that she was speaking at the other night and it looked more like a KKK rally. They have turned to out right racism and that is scary. Seems the Republican party now will try anything to win. So very sad to see a once proud party sink this low. I have talked with several independents who feel the same way and say they won't vote for McCain because of the racial tone the campaign has taken toward Obama. There are still alot of folks in this country that don't care about a mans education or character but will vote based on the color of his skin. Sad.

The registar stated that it would be logistically impossible to verify all of the applications before election day. So what do ya do? Throw all the application that out that ACORN gathered as being suspect? A genuine mistake of hiring miniumum wage people by ACORN? ...I think not. Plausible denialability by the Obama campaign...count on it.
IMO, Obama is not to be trusted.

The investigation into Sarah Palin's abuse of power began before she was chosen to run as McCain's VP. The investigation had absolutely nothing to do with the presidential campaign. Had McCain vetter her properly he would have known about the investigation and would not have chosen her.
Bill Ayers is not a "terrorist". He was a radical in the days when violence occurred on a regular basis, often perpetrated against the citizenry by the police. His statue bombing days (statues and empty buildings, no injuries) happened when Obama was 8 years old. By the time they met Ayers was a respected college professor.
Rev. Wright is a minister, he is passionate, he has said some things that I don't agree with. Big deal. Sarah Palin was prayed over by a witch hunter in her church, believes that the end of days are coming, and that dinosaurs coexisted with humans. Her active participation concerns me far more than Obama's listening to sermons.

I too would like to point out this whole investigation started well before she was brought into the National election. It is NOT an attempt to screw a National election. It is Alaska's attempt to fix a State issue. You can read it in all of the archives of major newspapers in Alaska - headlines in July etc.
So it's just a State thing. However if Palin is to run on her experience of being a Governor, then we get to measure and judge that experience ourselves. I don't know what "full access to the governor's office" means in regards to Todd Palin, but that sounds like Todd can use all the phones, copy machine, pens and letterhead that he wants. The fact that he's making phone calls to state employees regarding a personnel issue is mind-boggling. I don't want this guy in the Whitehouse. I'm sure the secret service and all the aids would really enjoy his daily interference in their jobs of helping McCain and Palin run the Nation.

- Yeah right... The press is supposed to drop everything to pursue a link between Obama and ACORN that has absolutely zero evidence of wrongdoing to back it up? Then they should take that unsubstantiated claim and put it up on the same pedestal as the "Troopergate" report, which has been in the works for a long time, has been thoroughly investigated and approved by a mostly Republican panel of lawmakers?

BTW... Did anyone else notice that the "Troopergate" report was released in the late afternoon on a Friday? That is the exact time of the week when anyone who wants to minimize the impact of a piece of news releases it.
That way it fizzles out by Monday. It's an old, well known trick.

At the end of the day, none these diatribes makes a darn bit of difference. This country and this election is now being ruled by fear,uncertainty and loathing for each other. Each party is as guilty as the next. Each candidate has blemishes and past issues. Each voter will have to choose who they trust to get us out of this mess.
It appears by some of those who post on redding.com, that some have no problems insulting their neighbor or other posters for their ideals and to try to justify the pushing of their candiates agenda, no matter who they are in favor of. A very sad commentary on todays society. Remember, after all is said and done, you will still have to live next to your neighbor, regardless of who you vote for.
That is why I read far more than I post....unless you agree with the majority, no matter what the subject on redding.com, count on being attacked,insulted or both.

- Obama is a scholar who graduated at the top of his class. Obama was the editor of the harvard Law Review. Obama later became a professor and also Practiced constitutional law for many years. Obama was elected to the State Legislature in Illinois, a large state with a high population. Obama was a successful community organizer. Obama was elected to the US Senate. Obama has a proven track record of calm thinking and rational decision making. Obama has been fully vetted by both political parties and the press. He is a family man with a solid history of hard work. I agree with him on nearly every issue.

- It is my hope that he will institute policies in line with his stances on the major issues. I hope he dedicates a massive federal effort geared towards creating jobs in a new green collar economy. It's the best most logical path to energy independence, economic recovery and eventual reduction of our national debt.

Forget the "cracks me up" part... it's actually extremely scary.

The encouraging part of all this is that Obama has established a clear lead, not only nationally... but in key swing states too.

Actually, that would be untrue... the polling data is weighted heavily against first time voters... His current leads are not due to new registrations.
New registrations, the overwhelming majority of which are absolutely legit, are probably causing the current polls to UNDER report Obama's lead. Add to that the estimated "youth vote/cell phone factor" and then subtract the estimated "Bradley Effect" and Obama should still have a larger lead than the polls show.

why is this such a big deal for some of you? elected officials have been abusing power for years and no body complains. if we charge her with it then we should charge the government as a whole. the only difference between her and others is she is more middle class then all the other corrupt officials out there that is why i think this is such a big deal out there dont let it become a big deal here in the middle class community.

- It's a big deal because she is running for the second highest political office in the land.
- It's a big deal because it speaks to Palin's credibility and honesty.
- It's a big deal because it speaks to John McCain's judgment as a leader. If he can't properly vet his VP choice, and bases his choice upon how many votes it will get him (instead of qualifications and leadership ability)... then why should we trust him to choose a viable cabinet, to set foreign policy, negotiate with other countries or nominate judges?

They took voting machines from low income, predominantly black neighborhoods so that the lines ended up being very long, many people had to stand out in the rain. People who came to hand out umbrellas to those waiting to vote were removed forcibly by the police. But because that skewed votes in favor of the Republicans, there's nothing wrong with that, but this ACORN BS is disqualifying? How?

It is interesting to note that this thread seems to reflect the general state of affairs in the US when it comes to the strong polarization of US voters.
The campaign has become a dirt-digging smear fest.
This country was founded on quite possibly the greatest of ideals ever to be put to words as a form of government and albeit flawed as any human creation is orders of magnitudes superior to the fascist governments of past and present which this country is beginning to resemble.
What happens when the government strays so far from the Constitution and the people have forgotten the history of this country and the world and instead filled their minds with hatred? Look at what is happening in the US and in the UK. Will those who hold tight their inalienable rights and frredoms be branded terrorists and tried and hung for treason?
I love the dream of what America was supposed to be, a great beacon or enlightenment and freedom so ironically and disgustingly built upon the corpses of the native Americans. It seems that, as always, the putrid human negative and ignorance will drag it all down.
Good Show and Best Regards for this little planet full of little minds but every day I am inclined more and more to call a Taxi.

I take offense at being referred to as a liberal. I'm actually very conservative, in the true form of teh word. I am fiscally conservative, I want to be able to keep the money that I earn, and expect to pay for all of the goods and services that I receive. I am a social conservative because I believe that the Constitution was written mostly to keep the government out of our private lives, and I want the government to obey the founding fathers in that regard. Marriage should be defined only by the two people involved in it. Medical decisions should be made only by the patient, or in cases if incapacitation, their spouse or nearest family member. Unfortunately the Republicans ceased being truly conservative long ago.
