Trinity residents: Pull marijuana ordinance

The Trinity County Board of Supervisors heard comments Tuesday regarding the county's medical marijuana law that allows prescription holders to possess up to 12 mature plants and 3 pounds of processed marijuana, up from the state's limit of six plants and 8 ounces.

More than 40 community members addressed the board, urging supervisors to repeal the ordinance, and several suggested the county comply with federal law by disallowing medical marijuana use altogether.

Only five spoke in favor of the ordinance.

Officials with the county's health department reported that the ordinance has led to an increase in hundreds of violations that included guard dogs running loose, unpermitted dwellings, rentals being destroyed as grow houses, and septic lines draining into the ground or creek.

Teachers said their students are dropping out to "go into the family business." Residents and business owners reported attacks by dogs protecting grows, threats by people guarding pot gardens, and pot smoke in public places — including playgrounds and in front of stores.

Undersheriff Eric Palmer estimated 25,000 plants are growing in the Hayfork area alone.

"They're everywhere," he said. "One of my guys said it looks like a marijuana jungle over there."

Medical marijuana advocate Tom Ballanco argued for the county to support legal sales of prescription marijuana, legalized under Proposition 215.

"Proposition 215 is saying that we, the citizens of California, want a medical marijuana economy."

Judy Stewart disagreed.

"People in Hayfork are scared," she said. "They're scared of their neighbors, the dogs, and they're very angry with you three on the board who voted on this. Go to a zero tolerance and let Trinity County be a model for the rest of the state."

Supervisor Roger Jaegel concluded, "It is very clear that our communities want us to rescind this policy, and that is the very least we can do. I would even support a zero policy."

This issue is set as an agenda item for action on Oct. 28 at the Weaverville library.

Interesting. The independent republic of Tehama, where only Federal laws apply?

Posted by paul52 on October 9, 2008 at 7:46 a.m.

They want 3 pounds????? Please, do not look at me with a straight face and tell me that's "medical use". You pot smokers have a good thing going right now, prescriptions are easily purchased and you can grow more pot than any person of honor could possibly smoke. Why screw it up? Just be happy with your lazy underacheiving life and watch as much TV as possible. I hear any 60's sitcom is pretty funny stoned. Especially the one where the guy smokes pot his whole life, wakes up at 62 living in a trailor park and wonders "Where the hell did my life go?".

Dear Community

We all know it is scary to have a new law out there that allows the use of marijuana as medicine for certain people that really benifit from the use of it under their doctors care.
But we all know that other issues on hand concerning our community everywhere are suffering from more important things. But all i hear is mostly on marijuana. Not the educational support for our childrens' welfare, or health care, or more dangerious criminal that are in need of being dealt with.. I believe in supporting these sick people whom benifit from the use of marijuana . There must be a better soulution to protect these people whom are just trying to live life in a more tolerable invirerment that surrounds them.. And for those whom are doing this growing, should show more resposiblility than destroying other peoples homes and lands. Organicly grown is a better way to treat our land, lets not destroy it by being ill responsible.. Most people I know whom grow, do not destroy property or the land , so what story is made up to fit the opions of others whom disaprove of the laws that were set forth to be followed by all departments of Law and Community Board of Supervisors? Political Agendas? Q. If your loved one was dying and all else failed, ask your self if you would turn to a god given plant to help them?...
To all, whom support compasionate use act, and the SB420, we soulute you.

Gee whiz...
Where do you get your information? prescriptions are not easily obtained, and you can not grow more unless your doctor states that you benifit for more ,and for most , are too sick to grow for themselves, and Yes i can tell you with a straigt face that 3 pounds of pot is not enough for me to use within the year.. I use more.. I suffer from MS. and it takes more to cook with, it takes more to make food that agrees with my ailments. And most patietns that wake up are are grateful that they are facing another new day.You and others do not know unless you walk in our
paths and face our challenges on a daily basics. You think its fun, not being part of society and have jobs and be able to walk and play like normal citizens. I think that many take for granted their lives surrounding them. Until they face what we face... Get real... get educated.. research before you speak.. so to say...
I support it, becasue it worked for me..when all else failed.. MS is not easy to live with, let along for familys whom also have to deal with it...

Everything you listed can be acheived by Prescription drugs that have been legally sold and controlled for years. Medical Marijuana was an idea that was dreamed up by Marijuana users to help legalize the illegal drug. Yes it helps your ailments, but it was already available in Prescription form from your local pharmacist. And Federal drug laws trump State drug laws.

Posted by wbr47 on October 9, 2008 at 8:29 a.m.

I grow medical marijauna for myself...and only myself,, i don't sell it , nor do I allow any of it to get into the hands of children. I keep it for myself and use it to help my cronic pain, insommnia and a eating disorder.. I don't grow over the limits and don't pollute the enviroment(no chemicals used at all). I am not a crook or a lazy pothead,(though I do like 60's tv shows)..
I know some people grow over the limits and who use chemicals that do pollute,I know people that don't even smoke, got perscriptions from the doctor in Redding, and are growing just for the money they are wrong for doing this and screwing it up for everyone who wants do do it right and follow the rules.
Who knows what the answer is but I know that this law is needed and that most people want to follow the rules. Punishing all for what some are doing is wrong... we need this weed... Don't snuff it out.........That may turn me and others into crooks.and we don't want that ....

Lovey, apparently you don't understand that this story isn't really about the use of marijuana for medical use. It's about the people who are taking advantage of the law and growing it for sale to anyone. It's about the scumbags who are creating a dangerous environment for their neighbors by trying to protect their crops from other scumbags using any means necessary.

I know of a couple of people who have a prescription for marijuana and are also growing it. One guy told me about selling his crop of marijuana and how much money he's going to make. He isn't worried about if the people he's selling it to need it for medical purposes. He's only doing it to make money. I don't know as much about the other guy but I do know he sells to people who don't have a prescription.

I'm guessing you smoke a lot of pot. That would explain why you don't understand what this story is about. It's not about people who need marijuana to deal with their health issues. It's about people growing pot to sell it and make money. It would also explain why you inappropriately substitute the word, "Whom" every place where you should use the word, "Who" in your post. ;~}

I have neighbors who grow here in Shasta Co. well over 30 plants and it affects me everyday. I smell the plants growing, I smell them smoking it, etc. I do not care what other people do and if it helps them in their "pain" then so be it BUT I should not have to tolerate their decision.

Please explain to me how I tell my kids to "say no to drugs" but let them walk out our back door to smell it day in and day out? How do I reinforce keeping them clean and healthy?

Once again, why do I have to smell the crap? most evenings, I can not even open my windows. Why is that okay?

Posted by GrimKeeper on October 9, 2008 at 8:50 a.m.

If you could have 12 flowering, how many vegetative can someone possess? How many lbs. can someone travel with? Do they think that being able to possess 3 processed/packaged pounds will keep people from growing indoor in the winter? It won't. What's funny about it is you can have three processed lbs., but you can have 12 plants. Those 12 plants could easily produce 5 lbs. a piece during 1 season. It is like a puzzle that has no answer. You can have 3 dried pounds, but you can grow 60-70 lbs. in 1 summer? C'mon.

That really is quite the increase, it doubles the amount you can produce and increases the amount processed you can possess by about 800 percent. It is not about personnal use. If you used an Oz. a week, you would only use 3 and a quarter lbs. the whole year. I guess you could make cooking oils, massage oils, hash, butter and tinctures but...that still is alot of MJ. I think that Trinity County enjoys the revenue from all the growers who spend their money on supplies there at the stores so much that they want to embrace more growing. Gardeners are better than tourists hmm? Maybe for business and politics but is sounds like not for the residents.

Posted by redinwho on October 9, 2008 at 10:16 a.m.

You guys are all missing the point. Medicine is what it is. The biggest drug pushers are big pharma and big business and not to mention the big poisons on the streets controlled and regulated that are flown in from all over the world. Why don't you focus on the the real drug problems in America strung out dependent pill poppers and meth heads, these newer poisons that have been manufactured . Trinity County has meth problems just like Shasta County just like the State just like the World. This and a host of other dire circumstances (Again manufactured), such as the economic situation...and..and .and. Marijuana is not a new addition to this equation it has always been here and we have always benefited from our relationship with it.

3 pounds....48 ounces....384 eighths a year....That is over an eighth of an ounce a day, every day of the year. That means you wake up in the morning and you're high before your feet hit the carpet, around noon. Hello????

An eighth of pot a day isn't enough??? That's getting high all day, every day. Please, somebody post here who thinks they need more pot in their life than that....

Posted by bbennyc on October 9, 2008 at 12:31 p.m.

in response to redinwho

Actually, you're the one missing the point of the article. The point of the article is that too many people are taking advantage of the law and growing the pot for resale to whoever wants it. They are creating very dangerous situations. That's the point of the article. It had nothing to do with pharmaceutical companies. How did you get that out of this article?

If people are only allowed to grow a 6 plants and have 8 ounces of pot it's harder to do much more than just keep yourself supplied for your medical needs. But if the limit is raised to 12 plants and 3 pounds now it's worth while for the drug dealers to go into business. That is what the article is about. People taking advantage of the system to make a profit selling drugs to people who don't have a prescription.

This just isn't that hard to understand but for some reason some people replying to this story aren't able to comprehend it. They want people to believe that all of these people with the dogs and guns are just helping out some poor sick people. Well, obviously the people who think this have already gone through most of their daily allotment of weed and just can't think straight.

I do think that pot should be available to certain people with medical needs. but it's gotten so much beyond that now that somebody needs to take another look at how to regulate this.

Posted by bbennyc on October 9, 2008 at 12:36 p.m.

in response to paul52

You're right on about this except it's not just 3 pounds. It's also 12 plants. I don't know what the reasonable potential yield of 12 plants at a time would be but it is clearly waaaaay more than any one person could use for themselves. Unless they're eating big buds with salad dressing on it or making a big green bud hoagie sandwich every day there just isn't any way that even 2 people could go through that many pounds of pot.

Posted by yellowhak1 on October 9, 2008 at 1:40 p.m.

this is the least of our problems in case any of you haven't noticed.

Posted by Lollygagger on October 9, 2008 at 2:54 p.m.

Why not legalize it. Alcohol does far more harm than pot. The state could legelize it, regulate it, sell it, and even tax it. Maybe then we could get out of debt.

Posted by Bighurt on October 9, 2008 at 3:46 p.m.

in response to paul52

You are somewhat correct, an 1/8 a day is a lot to smoke. However I know some people who do this and it is very capable. As with any drug the more you use your tolerance increases so an 1/8 a day really isn't that much to smoke. Now what you don't realize is that when it is consumed in the form of food, ie brownies, cookies, etc, it takes a lot more of the drug thc to have the same effect. for example I only need to smoke a bowl to be high for an hour. On the other hand I would have to eat about an 1/8 or more if I wanted to feel the same effect. Some people don't like to just smoke it because this can be related to cancer. And if I was in chronic pain 24/7, then yes, I would want as much mary jane as I could get. After all, why we focus so much on this drug is laughable. The gov. can't make money on it so they call it war on drugs. Why don't they have a real war and take out Prescription Pills which kill more people each year than all of the illicit drugs combined!

Posted by paul52 on October 9, 2008 at 4:13 p.m.

in response to Lollygagger

I agree, nobody smokes pot and then beats on the wife and kids...

However, it is already legal for the folks who spent the $100 to get a prescription...And please be honest with me on this....how many dope growers do you know who would actually sent the IRS money on their crop if it was legal? I have always thought the "legalize it, tax it" arguement was a bit phony....If you legalize it, folks would complain about the taxes and still grow it illegally.

Posted by waynesmo on October 9, 2008 at 7:10 p.m.

What's all the fuss over pot, I don't even smoke it and I could care less. Why don't these Counties focus on Meth eradication, that stuff is destroying people and the environment.

Posted by punapride on October 9, 2008 at 9:49 p.m.

Legalize...this is an outrage. Why poison your body with manmade drugs (which you can od on & destroy your liver..unlike marijuana..go figure), when there are many herbal remedies that work better. Because we have old laws made during prohibition that don't make sense that should have been changed decades ago. Marijuana..or marihauna as it was once spelled, was a commonly used drug in many forms that you could buy at your local pharmacy here in the good ole USA. Refer to the Emporor Wears No Clothes, by Jack Herer if you need a reference, I highly recommend it. That's right..most uneducated or misguided people don't even realize that. In fact maybe Obama will change the law, since he is going to be our next Prez...He's pretty liberal & seems to have a good sense of reason! That is one program we can close down and save some big bucks on DEA on marijuana..., not to mention making space in our prisons so we can keep the real criminals behind bars, rather than having to cut them loose early due to lack of space.

Aloha

Posted by paul52 on October 11, 2008 at 8 a.m.

I think folks sitting around smoking pot all day is a waste of God given potential. Yeah, criticize me all you want for this opinion. My beef with some of the people in the article is the wanton exploitation of the Medical Marijuana law.

The article states that in Trinity County you are legally allowed 12 plants and three pounds of pot. Some people don't think that is enough....Anyone with a brain will summize that these losers are just looking for a way to sell their "medical marijuana". I have previously done the math showing that 3 pounds is getting up and chain smoking pot all day every day. In addition to being legally allowed to smoke this much, you are also allowed 12 plants. If folks want to legalize pot, then make the arguement with honor and integrity, don't bs me that you need more than 3 pounds a year.

Just because I think most all day pot smokers are lazy underacheivers doesn't mean I respect the all day drinker any more. I said "I agree, nobody smokes pot and then beats on the wife and kids..."

Moderation, right? Just don't look me in the eye and try to sell me that this whole argument isn't really about the total legalization of pot.

I would favor allowing up to 5 stalks being grown on your own property, no medical reason necessary. Marijuana would be legal today if the proponants of the legalization law were more clear in their thinking.....Instead, they just sit around and smoke pot...Kinda makes my point.

Do the people with medicinal use truely have a problem finding it?
Those that do have a prescription..Does your doctor tell you how much, and how often to ingest it? Or is it just take as needed, for such-and-such symptom?
Even aspirin and vitamins are not supposed to be over used. You can even die from an overdose of water! My point is, too much of anything is bad, and when does a self medicator know when its too much?

Posted by Hardworkin on October 12, 2008 at 9:37 a.m.

I personally know of atleast 4 people that have a medical marijuana card for injuries in the past. They smoke daily, but not for pain, for recreational use. They also grow it, and some sell it, and work very little, if at all. In my opinion thats fraud. Its these people that will ruin it for those that find a use for it, and can't afford street prices.
last thought: If you are smoking all day long for pain, you need a better pain killer.

My mother-in-law is permanently disabled BECAUSE of prescription medications that she had to take because prop.215 hadn't gone through yet. Now at least she can eat without throwing it back up thanks to her marijuana prescription, but she won't ever function like you "normal" people because of the damage all of the synthetic medications have done to her liver and stomach. You people who don't know what it's like to need such a miraculous plant that God himself blessed this earth with, who are lucky enough to not know what it's like to be so ill, should really just shut up about it.

The problem is that if what you are saying is true you are the exception and not the rule. The vast majority of people are using MMJ as a ruise so they can grow/sell/use. There is a huge backlash coming against MMJ, just look at Mendocino County for an example. They just had a vote and they moved their limits to the minimum.

It offends me that you group me or stereotyping me as being a "pot grower"when I only have a 215. You can go down to the pharmacy and get your meds.
