Public defense lawyer to face another charge

A public criminal defense attorney accused of public intoxication and resisting or obstructing a police officer in connection with an alleged drunken disturbance at a Redding nightclub in April is facing a new misdemeanor charge.

The Shasta County district attorney's office Friday filed a new criminal complaint alleging that Shasta County deputy public defender Michael Caleb Borges, 27, tried to intimidate or dissuade a witness last month at Win-River Casino, District Attorney Jerry Benito said Friday.

Benito, who stressed that Borges is a deputy public defender and not a deputy district attorney, said that Borges got into a heated argument at the casino on Sept. 12 with the owner of the Redding nightclub, Inderjit Grewal, where the April disturbance occurred.

Benito said the men had to be separated by a third party.

"This was not a friendly conversation," Benito said.

He said that Borges apparently blamed Grewal, a primary witness in that original case, for calling police to his business in April.

Borges is one of three public defenders who were arrested in connection with that April disturbance.

Joseph Michael Ahart is charged with single counts of public intoxication and unreasonable noise, while Amy Margaret Babbits is charged with two misdemeanor counts of resisting or obstructing an officer and one count of public intoxication.

In that first case, Borges was charged with three counts of resisting or obstructing an officer and a count of public intoxication.

All three are due in Shasta County Superior Court on Oct. 10 for a settlement conference.

Benito said that Ahart and Borge's mother were with Borges at Win-River during the alleged disturbance last month, but Ahart's involvement "did not rise to the level of a crime."

Borges is to surrender himself to the Shasta County jail for booking and could be arraigned on the new misdemeanor charge at next week's settlement conference, Benito said.

Shasta County Public Defender Neal Pereira said Friday that an independent county investigation into the behavior of his three deputy public defenders was almost complete.

But the new misdemeanor charge against Borges will most likely extend it, he said.

The findings of that investigation could result in disciplinary action against the trio of young lawyers, he said.

"The whole thing is being taken very seriously," Pereira added.

Although any discipline would be confidential, it could vary from a letter of reprimand to job termination, he has said.

Benito has said that each misdemeanor count carries a maximum sentence of six months in jail, but that it would be highly unlikely for the co-defendants to receive lengthy jail sentences if convicted.

Benito has said that the April 26 incident started when police responded to a report of a man urinating in the parking lot of Club 151, a nightclub on Bechelli Lane.

That man later was identified as 24-year-old Peter Patrick Ahart of Williams, Joseph Ahart's brother, he said.

When police confronted the Ahart brothers, Babbits and Borges came out of the bar and a disturbance ensued that culminated in their arrests, Benito said.

Peter Patrick Ahart since has pleaded no contest to urinating in public, an infraction, and was fined $157. A misdemeanor count of public intoxication against him was dismissed.

While there may be some good sense in allowing employers to keep confidential the discipline records of their employees, it seems to me that some positions in society (such as public defender, D.A., police officer, judge, etc.) should be an open book to the public. How else can the public be aware of the integrity of those who serve critical roles in our society? It is ironic that I can obtain all the details of misbehavior and subsequent discipline for Dr. Moon, whose behavior will never directly affect me, and yet I cannot obtain information on the officer of the court or law enforcement officer whose behavior may very well affect me directly.

who are the real intimidators here?

Sounds like the DA and RPD are doing a fair bit of intimidation themselves.

The DA's office and the police departments CANNOT allow a culture to develop where the public defenders are seen the bad guys.

Public defenders are as important to the system, if not more so, than the prosecutors.

Didn't another P.D. get a DUI a while back? It sounds like perhaps the P.D.'s office has a culture of drinking. I assume they try to limit their clients' time in AA.

This just makes me wonder how this guy still has a job. It seems like intimidating a witness should cause him to get fired and not be allowed to be an attorney. I wonder how he's dealt with witnesses in the cases he's handled.

Actually if you knew anything about what you were talking about you would see this guy is being treated with velvet gloves. He was asked to turn himself in, the average civilian would have been arrested on a warrant. By all means though don't educate yourself just continue being a blathering idiot.

What is the relationship of the owner to the RPD?

It is ILLEGAL for a police officer's peace to be disturbed but somehow after the police arrived we have a disturbance.

Apparently, the RPD sycophants are out there waiting with their fingers crossed to bust every public defender. Yea that's NOT intimidation.

Remember a few years back when It was NOT intimidation when the RPD tried to STEAL pictures from the Record Searchlight photographer after they shot a gult war vet in the back WHILE HE WAS ON THE GROUND, while RC photographed it?

Yea, that's NOT intimidation. Why would they do that? Yea, not so they could get their story straight, but just because they NEEDED the evidence. Yea, that's it.

Fortunately, they did not get the images and their story obviously did NOT fit the RC images and RPD was shown to be not truthful in that case.

Well, most of us don't get drunk, pee on the sidewalk outside of a bar and then scream at the police when they are called that they can't touch us because we're with the public defender's office. Then when arrested and facing charges, most of us don't bump into a witness out in public and get in his face for testifying against us. In that way I guess you could say that we are above reproach. Being an attorney does not make one above the law, or common sense and decency.
