Redding sex offender gets 25 years-to-life prison term

A Redding man was sentenced today on a single felony charge of failing to register as a sex offender and will serve a 25 years- to- life prison term under California’s three strikes law.

James Richard Murphy, 49, pleaded guilty to the charge on Wednesday and was sentenced today in Shasta County Superior Court, said a spokesman for the Shasta County District Attorney’s office.

Murphy had been convicted in 1992 for molesting a 7-year-old girl. He also had been convicted in 1986 and 1997 of residential burglary, the spokesman said.

Murphy was arrested in March by Anderson police on suspicion of possessing methamphetamine. He had been living in Redding at the address where he was registered until May 2007, but failed to notify authorities about his move to Anderson.

And another one down, and another one down, and another one bits the dust! This sentence is perfect since the Supreme Court knocked down the death penalty for child rapist/molesters this is the next best thing. Too bad they didn't add on the no possibility of parole clause.

I thought three-strikes was for violent felonies. This guy gets sent up for failure to register? I call BS.

The third strike can be for any felony the prior two strikes have to be for a serious or violent felony. How many chances do you give dangerous people? I guess its okay with you that a sex offender who molested a 7 year old is avoiding registering so that the police can't track him. Makes me wonder what registration requirements you have.

This man was convicted of molesting TWO 7 year olds in 1992 and again convicted of sex with a third minor in 1997, while on probation for first child molestation convictions.

Actually, you are wrong. The three-strikes law was enacted for people who have been convicted of a serious criminal offense on three or more separate occasions. The convictions do not necessarily have to be violent in nature.

You might want to ask yourself a few questions. If after being convicted of molesting a 7 year old, why was he breaking into a location later? Was he doing this in hopes of locating another victim, or just trying to steal to support his methamphetamine habit? People on methamphetamine make rational decisions and are not a danger to our community? (yeah right!) Why didn't he notify authorities he had moved, when by law he is required to do so based on his molestation conviction? Do you think that a child molester, who was previously convicted of harming a 7 year old and is now flying under the radar does not pose a threat to society?

This guy is one of the reasons the three-strikes law was enacted in the first place.

I call it the law.
Raping a child is violent and sick. It is highly imparitive that society keep track of the pedophiles. It is a very significant part of their parole and or release.

So just because he didn't re-offend again this time, and 'only' failed to register as a sex offender, thus concealing himself amongst society, he should be given yet another chance? I'm having difficulty figuring out your logic??

This may be the third strike on his rap sheet, but I can almost guarantee you that he has another dozen or so serious felony crimes that he got away with. Good riddance.

The "third molestation" would not have been a third strike because strikes are convictions sustained prior to the commission of a new crime. If he breaks into ten homes, or does ten robberies, or threatens ten people, but has no prior history, he's not going to get life.

Once again, crosemeyer, you're spouting legal theories when you don't know (or appreciate) the law.

I don't feel any sympathy. If I had two strikes, I would be going above and beyond to comply with the laws. That means the "failure to register" is not just a simple or solitary issue.

Face it, these losers are lucky they lasted as long on the streets as they did. Most did more crimes than they got caught for, so catching them for 3 felonies is just a matter of time since they will not stop on their own, whether it is molesting kids, selling meth, stealing from neighbors, or robbing 7-11.

MoralMinority- YOU ARE AN IDIOT. Enough said. Person or not-they did a very horrifying thing RAPING a CHILD! I feel sorry for the kids you have or will have in the future. I want the DEATH PENALTY for anyone who rapes a child! Send petitions to our senators! I have written a letter every week and I send it in. Keep on trying!
